Bradley Secures GAO Protest Victory for Client Pinnacle Solutions

HUNTSVILLE, Ala. (Aug. 22, 2017) – Bradley Arant Boult Cummings LLP is pleased to announce that the firm secured a favorable decision from the U.S. Government Accountability Office (GAO) on a bid protest that was filed on behalf of the firm’s client, Pinnacle Solutions, Inc. (Pinnacle) of Huntsville.

Pinnacle had protested the exclusion of its proposal from the competitive range under the request for proposals (RFP) issuedAug. 19, 2016, by the National Aeronautics and Space Administration (NASA). The RFP was for aircraft logistics, integration, configuration management, and engineering services at the Lyndon B. Johnson Space Center and Ellington Field, both in Houston; the NASA Forward Operating Location in El Paso, Texas; the Langley Research Center in Hampton, Va.; and other locations. Pinnacle argued that NASA misevaluated its proposal and unreasonably excluded it from the competitive range.

In May, the GAO sustained Pinnacle’s protest, ruling that the evaluation record did not reasonably support NASA’s evaluation of Pinnacle’s proposal, and also reflected apparent disregard of aspects of its proposal and application of unstated evaluation criteria.

The GAO recommended that NASA reevaluate Pinnacle’s proposal under the RFP criteria and make a new competitive range determination. The GAO also recommended that NASA determine whether its evaluation criteria are reasonably disclosed in the RFP, and if appropriate, amend the RFP to clarify the basis for its evaluation and provide an opportunity for offerors to submit revised proposals. In addition, the GAO recommended that NASA reimburse Pinnacle for the costs of filing and pursuing the protest, including reasonable attorneys’ fees.
